STEP TWO: The Small Claims Court Judgment
The court mails a notice of the small claims judgment
to both the claimant and the defendant within a few days to a
few weeks after the hearing. The small claims judgment usually
includes the costs (filing fees) for bringing the claim to court
and one typical collection attempt by a sheriff or marshal. The
judgment is enforceable for twenty years, accrues interest and
should be enforceable outside the county and even outside New
York State with some exceptions. Either party can appeal a judge's
decision to an appellate court on the basis that "substantial
justice" was not done.
