{"id":1359,"date":"2015-04-06T11:15:00","date_gmt":"2015-04-06T15:15:00","guid":{"rendered":"http:\/\/www.nypirg.org\/capitolperspective\/?p=1359"},"modified":"2015-05-12T06:45:08","modified_gmt":"2015-05-12T10:45:08","slug":"flawed-budget-and-ethics-deals","status":"publish","type":"post","link":"https:\/\/www.nypirg.org\/capitolperspective\/flawed-budget-and-ethics-deals\/","title":{"rendered":"FLAWED BUDGET AND ETHICS DEALS"},"content":{"rendered":"<p>FLAWED BUDGET AND ETHICS DEALS<\/p>\n<p>The big news last week was the passage of the new state budget.\u00a0 As has happened all-too-often, the budget was the product of horse trading and negotiations conducted in secret.\u00a0 That\u2019s right, despite the fact that it\u2019s your money, Governor Cuomo and state lawmakers agreed to a $142 billion state budget and approved it in a way that meant that New Yorkers only found out the details after the fact.<\/p>\n<p>And when deals get done in secret, too often rank and file lawmakers don\u2019t have time to understand the consequences of their own budgetary decisions.<\/p>\n<p>Such is the case with the ethics agreement.\u00a0 The governor and legislative leaders cut a deal on changes to the state\u2019s ethics laws and then jammed it into the education budget with only hours for public review.\u00a0 As a result, despite the self-congratulatory news releases and spin, the closer one inspects the ethics deal, the weaker it gets.<!--more--><\/p>\n<p>In fact, the new ethics law is more loophole than law.<\/p>\n<p>Let\u2019s start from the beginning.\u00a0 In February, after the arrest of long serving Assembly Speaker Sheldon Silver \u2013 and after pulling the plug on a commission he set up to investigate state government ethical lapses \u2013 Governor Cuomo spoke about ethics at NYU Law School.<\/p>\n<p>&#8220;The challenge&#8221; the governor said was &#8220;the inherent conflict of interest posed by outside employment. . . . \u00a0Are clients paying privately for the actions of a public official?&#8221;<\/p>\n<p>The governor nailed it when he said: &#8220;The cleanest solution is to end the conflict rather than attempting to police or regulate it. . . . Congress probably has the best compromise model&#8221; that caps the amount of outside income any member can make.<\/p>\n<p>Instead of calling for a limit on the total amount and sources of outside income\u2014as Congress did post Watergate\u2014the governor took a U-turn in his speech:<\/p>\n<p>&#8220;We will propose what we call \u2018total disclosure\u2019\u2014the most extensive disclosure of outside income in the United States of America. \u00a0You have heard the phrase \u2018follow the money.\u2019 \u00a0We\u2019re creating a new expression, \u2018explain the money.\u2019&#8221;<\/p>\n<p>A version of the governor\u2019s proposal passed both houses under literal and figurative cover of darkness this week.\u00a0 More window dressing than reform, the package falls far short of even the inadequate &#8220;total disclosure&#8221; or &#8220;explain the money&#8221; standards set by the governor.<\/p>\n<p>Here are two key parts of the governor\u2019s proposal that passed:<\/p>\n<ol>\n<li>Legislators will provide a general description of the professional services they offer while moonlighting, for example as lawyers, insurance and commercial real estate brokers; and<\/li>\n<li>They\u2019ll report more detail about clients who pay their firms $10,000 or more a year for services related to state government action, such as legislation, budget items and contracts.<\/li>\n<\/ol>\n<p>These changes may have been groundbreaking ten years and dozens of scandals ago.\u00a0 From the perspective of 2015, it\u2019s clear the loopholes are so plentiful and so large that government watchdogs are uniformly underwhelmed.\u00a0 Here are four of the problems with these so-called &#8220;historic&#8221; reforms:<\/p>\n<ol>\n<li>Legislator-lawyers and other professionals who do not provide direct services, like those who are &#8220;of counsel&#8221; or managing partners, will continue to practice without having to disclose much of what they do to make money.<\/li>\n<li>Lawyer-legislators will be able to seek an exemption from disclosing their clients in cases where they believe disclosure &#8220;may result in undue harm to the attorney-client relationship.&#8221;<\/li>\n<li>Longstanding clients may be &#8220;grandfathered&#8221;
