{"id":3165,"date":"2025-03-31T08:40:20","date_gmt":"2025-03-31T12:40:20","guid":{"rendered":"https:\/\/www.nypirg.org\/capitolperspective\/?p=3165"},"modified":"2025-03-31T08:40:20","modified_gmt":"2025-03-31T12:40:20","slug":"another-late-budget-with-washington-looming","status":"publish","type":"post","link":"https:\/\/www.nypirg.org\/capitolperspective\/another-late-budget-with-washington-looming\/","title":{"rendered":"Another Late Budget, With Washington Looming"},"content":{"rendered":"\n<p>April 1<sup>st<\/sup> is the <a href=\"https:\/\/www.nysenate.gov\/new-york-state-budget\">first day<\/a> of New York\u2019s fiscal year, meaning that it is the day when a new state budget should be in place. Yet April 1, 2025 will come and go, without a new state budget on the books.<\/p>\n\n\n\n<p>While late budgets are nothing new, this year\u2019s faces a huge uncertainty: whether the Congress will approve a federal spending plan that blows a big hole in New York\u2019s budget.<\/p>\n\n\n\n<p>First some background. Under New York State\u2019s <a href=\"https:\/\/dos.ny.gov\/system\/files\/documents\/2022\/01\/Constitution-January-1-2022.pdf\">Constitution<\/a>, the executive branch is required to submit a balanced budget to the Legislature, usually in January. In contrast to other states, New York\u2019s fiscal year starts on April 1<sup>st<\/sup> \u2013 the <a href=\"https:\/\/www.ncsl.org\/fiscal\/fy-2023-state-budget-status\">earliest<\/a> in the nation. While that gives lawmakers only three short months to cobble together a state budget, for the vast majority of the decades that the requirement has been in place, budgets were set more or less on time. It wasn\u2019t until the <a href=\"https:\/\/www.nytimes.com\/1985\/04\/01\/nyregion\/state-lacking-budget-to-use-federal-funds.html\">mid-1980s<\/a> that the fiscal \u201cwheels\u201d started to come off, with one budget being adopted <a href=\"https:\/\/www.wnyc.org\/story\/68686-new-yorks-budget-late\/\">133 days<\/a> after the beginning of the fiscal year! New York\u2019s court system changed that with a <a href=\"https:\/\/law.justia.com\/cases\/new-york\/court-of-appeals\/2004\/2004-09320.html\">decision<\/a> in 2004 that gave the governor far more control over the budget process. Since then, delays in producing a final budget have been much shorter.<\/p>\n\n\n\n<p>Add this <a href=\"https:\/\/gothamist.com\/news\/gov-hochul-lawmakers-to-miss-ny-budget-deadline-again\">year<\/a> to the list of late budgets.<\/p>\n\n\n\n<p>This year\u2019s budget delay is tied to significant differences \u2013 some financial and some not \u2013 between the executive and legislative budget plans. For example, the governor and the Legislature have offered their own financial plans that spend different <a href=\"https:\/\/nysfocus.com\/2025\/03\/17\/new-york-state-budget-guide-2025\">amounts<\/a>, with the governor proposing a $252 billion budget, the Assembly at $257 billion, and the Senate\u2019s budget at $259 billion. Negotiating those differences is a key step in getting the budget done. Another major spending item to figure out: how to fund the Metropolitan Transportation Authority (MTA); all agree on spending $3 billion, but there is no agreement on <a href=\"https:\/\/archive.ph\/o\/aW8Iq\/https:\/www.newsday.com\/opinion\/editorials\/lirr-mta-capital-plan-hochul-ijy7ye2r\">how<\/a>.<\/p>\n\n\n\n<p>It&#8217;s not just about the numbers though. Policy differences can derail budget negotiations. Two years ago, it was Governor Hochul\u2019s <a href=\"https:\/\/www.nbcnewyork.com\/news\/politics\/ny-judges-to-get-more-power-in-setting-bail-part-of-229b-state-budget-deal-hochul\/4283921\/\">demands<\/a> in the area of public safety that jammed up the budget process. Last year, <a href=\"https:\/\/www.politico.com\/news\/2024\/01\/09\/hochul-pushes-more-limited-plan-to-spur-housing-00134619#:~:text=In%20her%20State%20of%20the,housing%20shortage%20and%20political%20realities.&amp;text=NEW%20YORK%20%E2%80%94%20Gov.,and%20cities%20across%20the%20state.\">housing<\/a> policy was a sticking point.<\/p>\n\n\n\n<p>This year, reportedly there are <a href=\"https:\/\/spectrumlocalnews.com\/nys\/central-ny\/politics\/2025\/03\/29\/state-budget-due-tuesday-\">four<\/a> major policy differences among the three leaders: a restriction on wearing masks in public, a ban on cellphone use in K-12 schools, and two issues dealing with public safety.<\/p>\n\n\n\n<p>None of those proposals have a significant financial impact on the state. But the governor is using budget negotiations to advance her policy initiatives.<\/p>\n\n\n\n<p>Looming in the background is the impact that the Trump Administration and the Congress may have on the state\u2019s finances.<\/p>\n\n\n\n<p>The House of Representatives has advanced a budget <a href=\"https:\/\/www.nbcnews.com\/politics\/congress\/house-budget-vote-speaker-johnson-trump-agenda-rcna193626\">plan<\/a> that contemplates big cuts to federal programs and the extension of a massive tax cut. The U.S. Senate has adopted a budget <a href=\"https:\/\/www.nbcnews.com\/politics\/congress\/trump-endorses-house-gop-budget-bill-swipe-senate-plan-rcna192791\">plan<\/a> that is significantly at <a href=\"https:\/\/www.nbcnews.com\/politics\/congress\/house-senate-gop-approved-competing-budget-plans-now-comes-hard-part-rcna193808\">odds<\/a> with the House. With both houses having advanced their own plans, <a href=\"https:\/\/www.politico.com\/news\/2025\/03\/30\/gop-budget-house-vs-senate-00258076\">efforts<\/a> to reconcile their differences are ramping up.<\/p>\n\n\n\n<p>Given the narrow House <a href=\"https:\/\/about.bgov.com\/insights\/congress\/balance-of-power-in-the-u-s-house-and-senate\/#which-party-currently-controls-congress\">majority<\/a>, the seven New York State Republican Representatives can play a <a href=\"https:\/\/www.cityandstateny.com\/politics\/2025\/03\/possible-gop-cuts-medicaid-put-lawler-awkward-position\/404149\/?oref=csny-homepage-river\">key role<\/a> in deciding whether New York\u2019s budget suffers devastating cuts at the hands of Congress. Whether they choose to do so, only time will tell, but the difficulties facing the Congressional Republicans make it clear that New York Representatives can play an outsized role in protecting the state.<\/p>\n\n\n\n<p>Which brings us back to Albany. Despite the uncertainties surrounding discussed federal cuts in spending \u2013 no one knows for sure how much will be cut \u2013 state lawmakers must cobble together a plan of their own. And they need to do so quickly.<\/p>\n\n\n\n<p>State budget makers are well aware of the <a href=\"https:\/\/www.nytimes.com\/2025\/03\/27\/nyregion\/trump-budget-new-york.html\">danger<\/a>, but they simply cannot predict what Congress will do. So, the game plan has been to pass a state budget and then return to address any shortfalls once the dust settles in Washington.<\/p>\n\n\n\n<p>For Governor Hochul and state lawmakers, they have once again failed to deliver an on-time budget, a job that they were elected to do. Not only is the state\u2019s fiscal plan overdue, but it may get seriously more complicated once Congress finally acts. In this three-dimensional chess match, the first move is Albany\u2019s.
