The first week of January is when lawmakers return for the beginning of the <a href=\"https:\/\/nyassembly.gov\/leg\/calendar\/\"><u>2026 legislative session<\/u><\/a>. The following week, Governor Hochul will <a href=\"https:\/\/www.governor.ny.gov\/schedule\/2026-state-state-address\">release<\/a> her \u201cState of the State\u201d address and the week after that, she will release her executive budget.<\/p>\n\n\n\n<p>The State of the State is an annual message delivered by the governor as required under the <a href=\"https:\/\/dos.ny.gov\/system\/files\/documents\/2025\/01\/constitution-january-1-2025.pdf\"><u>state Constitution<\/u><\/a>. It leans to the poetry of governing, long on goals, short on the details of achieving them.<\/p>\n\n\n\n<p>It is really the budget that provides the governor\u2019s blueprint for how she will achieve her goals.<\/p>\n\n\n\n<p>So, a lot is happening right now to develop the massive state budget and fashion it to meet the outcomes that the governor will propose in her annual message.<\/p>\n\n\n\n<p>Next year\u2019s budget plan is being developed under the large shadow cast by the changes enacted by the President and the Congress. The state will have to figure out, for example, how to provide health coverage for the tens of thousands of New Yorkers who are facing a complete <a href=\"https:\/\/www.health.ny.gov\/press\/releases\/2025\/2025-09-10_federal_funding_cuts.htm\"><u>loss of coverage<\/u><\/a> or huge increases in the costs of providing that coverage. The Trump Administration and its allies in Congress are doing all that they can to reduce Americans\u2019 access to health insurance, a decision that will result in misery and physical harm to millions of Americans.<\/p>\n\n\n\n<p>Proposals that can raise revenues, therefore, will get a closer look as the state budget makers try to address shortfalls resulting from Congressional action.<\/p>\n\n\n\n<p>One idea that has been considered over the years pertains to the use of and addiction resulting from tobacco and other nicotine products.<\/p>\n\n\n\n<p>We all know the score on that front. Tobacco products, when used as directed, addict and kill. Lung cancer is most often<a href=\"https:\/\/www.cdc.gov\/cancer\/lung\/basic_info\/risk_factors.htm#:~:text=In%20the%20United%20States%2C%20cigarette,Many%20are%20poisons.\"> <\/a><a href=\"https:\/\/www.cdc.gov\/cancer\/lung\/basic_info\/risk_factors.htm#:~:text=In%20the%20United%20States%2C%20cigarette,Many%20are%20poisons.\"><u>caused<\/u><\/a> by tobacco use. But lung cancer is <em>not<\/em> the only cancer that can be caused by tobacco use. According to the U.S. Centers for Disease Control and Prevention<a href=\"https:\/\/www.cdc.gov\/vitalsigns\/cancerandtobacco\/index.html#:~:text=It%20can%20cause%20not%20only,cancer%20related%20to%20tobacco%20use.\"> (<\/a><a href=\"https:\/\/www.cdc.gov\/vitalsigns\/cancerandtobacco\/index.html#:~:text=It%20can%20cause%20not%20only,cancer%20related%20to%20tobacco%20use.\"><u>CDC<\/u><\/a>), tobacco use results in cancers of the mouth and throat, voice box, esophagus, stomach, kidney, pancreas, liver, bladder, cervix, colon and rectum, and a type of leukemia. And tobacco users aren\u2019t the only ones at risk; exposure to tobacco smoke by those who are <a href=\"https:\/\/www.cdc.gov\/tobacco\/secondhand-smoke\/about.html\"><u>non-smokers<\/u><\/a> raises their risk of cancer.<\/p>\n\n\n\n<p>While past actions taken by New York (and much of the rest of the nation) have dramatically <a href=\"https:\/\/cnycentral.com\/news\/new-york-news\/new-york-adult-smoking-rate-drops-historic-low-marking-a-public-health-victory\"><u>reduced<\/u><\/a> the cigarette smoking rate, flavored products, <a href=\"https:\/\/www.cdcfoundation.org\/blog\/Nicotine-Pouch-Use-Surges-Among-Young-People\">new forms<\/a> of nicotine use, and the use of other non-cigarette tobacco products are still dangerous.<\/p>\n\n\n\n<p>Flavored tobacco products are <a href=\"https:\/\/www.fightcancer.org\/policy-resources\/flavors-tobacco-products#:~:text=Flavors%20are%20a%20marketing%20weapon,Guidance%20on%20Characterizing%20Flavors%E2%80%9D).\">designed<\/a> to entice youth to a deadly addiction. It is still legal to sell menthol-flavored cigarettes and other flavored tobacco products. While New York now <a href=\"https:\/\/www.health.ny.gov\/press\/releases\/2023\/2023-02-09_flavored_tobacco_products.htm#:~:text=No%20wonder%20Black%20Americans%20die,Legislature%20to%20adopt%20her%20plan.%22\">prohibits<\/a> the sale of flavored vaping products, it has not banned the sale of flavored tobacco. Experts that evaluate the state\u2019s tobacco program have <a href=\"https:\/\/www.health.ny.gov\/prevention\/tobacco_control\/docs\/2022_independent_evaluation_report.pdf\"><u>urged<\/u><\/a> a ban on the sale of these flavored tobacco products.<br><br>New York policy fails in a key area of the fight to combat nicotine addiction: tax policy. And it is this area that budget makers may be looking at.<\/p>\n\n\n\n<p>New York State currently has the <a href=\"https:\/\/spectrumlocalnews.com\/nys\/central-ny\/politics\/2023\/08\/29\/new-york--1-cigarette-tax-hike-goes-into-effect-this-week\"><u>highest cigarette tax<\/u><\/a> in the nation, at $5.35 per pack. There is irrefutable <a href=\"https:\/\/www.who.int\/activities\/raising-taxes-on-tobacco\"><u>evidence<\/u><\/a> that increasing the cost of cigarettes has been a key component in the state\u2019s tobacco control success.<\/p>\n\n\n\n<p>Yet New York taxes non-cigarette tobacco products and other nicotine delivery products (like <a href=\"https:\/\/www.nyc.gov\/site\/doh\/about\/press\/pr2025\/new-data-show-vaping-persists-among-young-new-yorkers.page\">vaping<\/a>) at a different, and lower, rate. In doing so, it essentially drives smokers and would-be smokers to these products, undermining the impact of the increase in cigarette taxes and deprives the state of revenue. Additional revenues that could add tens of millions of dollars to the state coffers.<\/p>\n\n\n\n<p>And that may be the \u201chook\u201d to get budget makers interested.<\/p>\n\n\n\n<p>Increasing the price of non-cigarette tobacco products by raising tax rates reduces the demand for those products, which, in turn, leads to significant reductions in their use. Those reductions help lower health costs while increasing state revenue.<\/p>\n\n\n\n<p>It makes sense from a public health perspective and makes sense from a state revenue perspective.
